These Terms of Use (“Terms”) govern your access to and use of https://azusadiscovery.com (the “Website”), operated by Azusa Discovery Center Preschool and School Age, Inc. (“ADC,” “we,” “our,” or “us”), a licensed child care provider in Los Angeles County, California (License #198021516).

By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. Who May Use the Website

The Website is intended for adults — parents, guardians, prospective families, job applicants and members of the public. It is not directed to children under 13. If you are under 18, please use the Website only with the involvement of a parent or guardian.

2. Permitted Use

You may view, print and download material from the Website for your own personal, non-commercial use in evaluating or using our services. You agree not to:

When you submit an inquiry, tour request, newsletter signup or job application, you confirm that the information you provide is accurate and that you have the authority to provide it — including any information about a child.

Please do not submit sensitive information through the Website’s public forms, including medical records, social security numbers, financial account or payment card details, or immigration status. Communication over the internet is not guaranteed to be secure or confidential. Where we need sensitive information for enrollment, we will collect it from you securely and separately.

Any feedback, suggestions or ideas you send us may be used by us without restriction or obligation to you.

5. No Enrollment Contract; Program Information

Program descriptions, schedules, ratios, curricula, tuition, fees, hours and availability shown on the Website are provided for general information, may change without notice, and may contain errors or omissions. The terms that apply to your child’s care are those in your signed enrollment agreement, our parent handbook, and applicable California licensing requirements — not this Website. In the event of a conflict, those documents control.

6. Not Medical, Developmental, Legal or Financial Advice

Articles, resources and general guidance on the Website (including material about child development, health, nutrition or safety) are for information only and are not a substitute for advice from your pediatrician or another qualified professional. Always seek the advice of a qualified professional with any questions about your child’s health or development, and never disregard or delay seeking professional advice because of something you read here. In an emergency, call 911.

7. Photographs and Media

Images of children appearing on the Website are published only with written parent or guardian consent. You may not copy, download, reproduce, alter or redistribute any image of a child from this Website for any purpose. Requests relating to a child’s image should be sent to contact@azusadiscovery.com.

8. Third-Party Links and Services

The Website contains links to and embedded content from third-party services — for example maps, social media feeds, review platforms, translation tools, and our childcare management platform. We do not control those services, we do not endorse their content, and we are not responsible for their availability, accuracy, or privacy and security practices. Your use of a third-party service is governed by that provider’s own terms and privacy policy.

9. Privacy

Our collection and use of personal information through the Website is described in our Privacy Policy, which forms part of these Terms.

10. Availability and Changes

We may change, suspend, restrict or discontinue any part of the Website at any time without notice. We do not guarantee that the Website will be available without interruption or free of errors.

The Website and all content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Website will be uninterrupted, secure, or free of viruses or other harmful components. To the fullest extent permitted by law, ADC, its owners, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your access to or use of (or inability to use) the Website, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability arising out of or relating to the Website will not exceed one hundred U.S. dollars (US$100).

Nothing in these Terms limits any liability that cannot lawfully be limited, and nothing in these Terms applies to or limits any obligation or liability arising from the actual care of a child at our facility, which is governed by our enrollment agreement and by applicable California law.

13. Indemnification

You agree to indemnify and hold harmless ADC and its owners, directors, employees and agents from any claim, demand, loss or expense (including reasonable attorneys’ fees) arising out of your misuse of the Website, your violation of these Terms, or your violation of the rights of any third party.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Website or these Terms will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. This section does not affect any right you may have to bring a matter before a government or licensing agency.

15. Accessibility

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding your use of the Website.
